FedEx Files Lawsuit Seeking Reimbursement for Trump-Imposed Tariffs
Trump introduced higher import tariffs last April on goods from most countries under the International Emergency Economic Powers Act (IEEPA). However, the US Supreme Court ruled last week that the law did not grant him authority to impose the levies. This decision opens the door for companies to seek refunds for the additional duties paid since last year.
"Plaintiffs seek for themselves a full refund from Defendants of all IEEPA duties Plaintiffs have paid to the United States," FedEx stated in its lawsuit.
The company did not specify the amount it is seeking in refunds. The suit names US Customs and Border Protection (CBP), its commissioner Rodney Scott, and the US government as defendants. FedEx said in its filing with the US Court of International Trade that it had been responsible for paying the tariffs and is seeking redress.
FedEx also said on Monday that it had "taken necessary action to protect the company's rights as an importer of record to seek duty refunds" from CBP following the Supreme Court ruling. The BBC has approached CBP for comment.
On the same day, 22 US Senators, all Democrats, introduced legislation requiring the Trump administration to fully refund all revenue, with interest, collected from the tariffs within 180 days. The legislation instructs CBP, which would manage the reimbursements, to prioritise small businesses.
It is estimated that the Trump administration collected at least $130 billion (£97 billion) from tariffs imposed on most imported goods through the IEEPA.
While the Supreme Court ruled the IEEPA tariffs were illegal, it did not clarify how the collected funds should be returned. Following the ruling, both Trump and Treasury Secretary Scott Bessent warned that the issue of refunds could take years to resolve in the courts.
